GENERAL TERMS AND CONDITIONS FOR RENTING OUT HOLIDAY HOME COUP DE COEUR

  1. Rental agreement

The landlord and the tenant expressly agree that the tenancy agreement can be concluded by sending e-mails.

The rental agreement will include the address of the holiday home, the rental period and the arrival and departure times. If necessary, the rental price, surcharges, deposit, cleaning costs and payment terms will also be stated.

By written or e-mail confirmation by the tenant of the rental agreement communicated by the landlord, the rental agreement between the parties is concluded and the tenant accepts these general rental conditions without any reservation.

2. Method of payment

Before a booking becomes final, 30% of the rental price has to be paid. The remainder of the rental price must be paid at least 6 weeks before the property is put into use.

The landlord’s obligation to provide access to the property is postponed until the rent has been paid in full.

In the event of late payment, the tenant will be in default. The landlord shall inform him of this in writing. He will then still be able to pay the amount due within 7 days. If payment is still not made, the rental contract will be cancelled on the day of default. The prepaid amount of 30% is then considered a cancellation fee.

If the rental agreement is concluded within 6 weeks before the day of commencement, the full rental price must be paid immediately.

The Landlord reserves the right to terminate the agreement due to important circumstances. In that case, the tenant will be informed as soon as possible of the cancellation of the rental contract and will be refunded the rent already paid within two weeks of cancellation.

3. Number of people

The holiday home is suitable for a maximum of 8 people.

The landlord has the right to deny the tenant the holiday home if this number is exceeded, without any right to compensation or refund of amounts already paid.

  1. Sublease

It is not allowed to sublease the holiday home.

  1. Acceptance of good condition

The landlord offers the property and the tenant accepts the property in the condition it is in, in good condition of maintenance, safety, hygiene and habitability.

  1. Damage

The tenant is liable for damage to the holiday home caused by himself and/or his travelling companions or visitors. He is responsible for the house during the rental period and he undertakes to keep the house tidy and clean.

The tenant accepts that the property is in perfect condition. If any damage is discovered at the start of the hire, the tenant is obliged to report this immediately to the landlord. If the hirer makes no comments at the start of the hire, any damage discovered by the person hiring out the accommodation after the end of the hire will be irrefutably presumed to have been caused by the hirer. If the tenant notices any damage, he shall immediately inform the housekeeper.

  1. Warranty

A deposit of € 300 will be paid to the landlord upon reservation. This will be refunded within 14 days of departure at the latest, after deduction of any consumption costs and any compensation in the event of damage or loss.

  1. Care for home and surroundings

The rented holiday home must be occupied with due care by the main tenant and the fellow tenants, taking into account the peace and quiet of the surroundings. The tenants will behave like a good family man and will protect the holiday home against fire, frost damage, burglary, etc. during the stay. The hirer hereby expressly acknowledges to be responsible for theft of and damage to household effects if the theft occurs without traces of forced entry. In the event of theft without traces of forced entry, e.g. due to windows and doors not being locked in the absence of the tenant, the tenant is liable for the damage suffered.

  1. The cleaning

The cleaning of the house is at the landlord’s expense and the costs include the rent. If the rental period is longer than 1 week, it is possible to have an additional cleaning at the expense of the tenant at an additional cost of € 50 per cleaning.

The main tenant has the following cleaning obligations:

  • Empty the bins (kitchen, toilet and bathroom) and dispose of the rubbish bags in the places provided (see brochures).
  • cleaning of the barbecue as well as the grids.
  • Empty the dishwasher – oven – microwave – coffee machine.
  1. Cancelation

In the event of cancellation by the hirer, he will owe the following compensation:

Up to 40 days before the start : 30% of the rental price

Less than 40 days up to 7 days before the start : 50% of the rental price

Less than 7 days before the start : 75% of the rental price

If the tenant does not use the holiday home or leaves it before the end of the rental period, no refund will be made.

The tenant is responsible for taking out cancellation insurance.

  1. Swimming pool

The tenant is responsible for the supervision of children in and around the swimming pool. The swimming pool must be closed if there is no parental supervision.

Pets are allowed subject to prior agreement. For hygienic reasons, it is absolutely forbidden to allow your pet into the swimming pool.

  1. Parking of the car

The vehicle must be parked at the entrance gate.

  1. Complaints and jurisdiction

No complaint will be taken into consideration if it is not reported by telephone or electronically within 48 hours after taking possession of the holiday home and is confirmed by registered letter. The same rule applies if something serious occurs during the stay in the holiday home.

In case of dispute, only the court of Dendermonde in Belgium is qualified.

14. Coronavirus and cancellation policy.

If it is impossible to use the vacation home during the booked period due to restrictions imposed by the government of the country of origin or destination region, the vacation will be cancelled and the full amount reimbursed. Refunds will be made within 14 days of the end date of the booked period.   

The country of origin is the country where the main booker is based and the region is the department of Aude in France.

The situation in which the principal booker or someone from the travel company decides to cancel the booking, and in which no restrictions have been imposed by the government/authorities during the booked period, remains obliged to pay the cancellation fees applicable on the cancellation date.
